OFFICIAL RULES – Nationwide Dog Dugout Sweepstakes
These are the Official Rules for the Nationwide® Dog Dugout Sweepstakes ("Sweepstakes"). The Sweepstakes is sponsored by Nationwide Mutual Insurance Company ("Nationwide" or sometimes here after referred to as “Sponsor”), One Nationwide Plaza, Columbus, Ohio 43215.
No purchase is necessary to enter or win. Making a purchase will not increase the odds of winning.
1. Eligibility.
1.1. Open to Legal Residents. The Promotion is open to legal residents of the fifty United States and the District of Columbia, and except where excluded (as listed below) and prohibited by law, who: (a) are 18 years of age or have reached the age of majority in their jurisdiction of residence at the time of entry, whichever is greater, (b) are legally able to work in the United States, and (c) are the owner of a dog prior to August 14, 2023. The following states are excluded: GA, KS, KY,NH, ME, MT and WA. No purchase is necessary.
1.2. Additional Exclusions. Employees and agents of Nationwide, the PDL Entities, the MLB Entities (defined below) and each of their affiliates, subsidiaries, advertising and promotion agencies, and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (all of the foregoing, together with Nationwide, collectively referred to as "Promotion Entities") and their immediate family members and/or those living in the same household of such persons, whether related or not, are not eligible to enter the Sweepstakes. The “PDL Entities” means Sponsor, MLB Professional Developments Leagues, LLC (“PDL”), each PDL Club, each of their subsidiaries or affiliated entities, any entity which now or in the future controls, is controlled by, or is under common control with PDL and the PDL Clubs and PDL Leagues, and all officers, directors, employees, agents, partners, and members of those entities. The "MLB Entities" means the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs ("Clubs"), each of their parent, subsidiary, affiliated, and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities.
1.3. No Other Sponsorship. The Promotion is not sponsored by any of the PDL Entities or MLB Entities.
2. How to Enter.
2.1. Sweepstakes Period.
The sweepstakes starts 8/14/2023 at 12:01 am EST and ends 8/25/2023 at 11:59 pm EST (the “Sweepstakes Period”).
2.2. Entry.
At the conclusion of each day in the Sweepstakes Period, one (1) Daily Prize winner will be randomly selected from among all eligible entries received during that applicable day for a total of eleven (11) Daily Prize winners. At the conclusion of the overall Sweepstakes Period, one (1) Grand Prize winner will be selected from among all eligible entries received throughout the Sweepstakes Period. To enter, visit the Nationwide Dog Dugout Sweepstakes website and complete the fields on the entry form located at https://www.milb.com/about/nationwide-dog-dugout. Limit one (1) entry per person during the Sweepstakes Period.
2.3. Restrictions.
Nationwide will not consider ineligible, illegible, invalid, or incomplete submissions.
2.4. Conditions.
Entrants agree to be bound by the Official Rules and the decisions of Nationwide, which are final and binding on all matters relating to the Sweepstakes. Nationwide is not responsible for any typographical or other errors in printing the offer, administration of the Sweepstakes or the announcement of the prizes, or for lost, late, misdirected, damaged, incomplete or illegal entries.
2.5. Participant's Consent.
Entry constitutes consent to participate in Sweepstakes and for Nationwide to obtain, use, and transfer the entrant's photo for Sweepstakes administration purposes. By participating in the Sweepstakes and/or accepting any prize, Entrants grant Nationwide permission to use their name, likenesses, and image in connection with the Sweepstakes for purposes of advertising, publicity, and promotion purposes, without further compensation to the entrant, unless prohibited by law.
3. Drawing.
MiLB will notify the winners via email or phone within ten business days of the applicable winner selection. If a winner is not eligible or if Nationwide cannot contact the winner, the winner's prize will be forfeited. The odds of winning depend on the number of eligible entries received.
4. Prizes.
4.1 Award. MiLB will randomly select one (1) Grand Prize winner and eleven (11) Daily Prize winners.
1. One (1) Grand Prize Winner will receive the opportunity for the winner’s dog to be featured in the Nationwide Dog Dugout logo on MiLB.com from January 1, 2024—December 31, 2024, a feature in The Companion newsletter, a goodie basket of select MiLB licensed dog apparel and Nationwide branded items (at Sponsors’ sole discretion), four (4) reserve tickets winner and three (3) guests to a 2023 regular season Minor League baseball game at their local ballpark (game chosen at Sponsor’s sole discretion) , one (1) $50 food voucher for the applicable ballpark, one (1) $100 team shop gift card, the opportunity for winner only to throw a ceremonial first pitch, and the opportunity for the winner’s dog to receive scoreboard recognition at a game in 2024 (at Sponsors’ sole discretion). TRANSPORTATION AND LODGING NOT INCLUDED. Exact nature and duration of the opportunity to throw out the ceremonial first pitch and the scoreboard recognition shall be determined in the sole discretion of PDL and subject to availability and the rules and regulations of PDL and MLB. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Winner’s guest(s) must be of legal age of majority in his/her(their) jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Minor League Baseball game/event/exhibition dates and times are determined in the sole discretion of the PDL and/or the applicable PDL Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by PDL, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Winner and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize. Sponsor and the PDL Entities reserve the right to remove or to deny entry to the winner and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Sponsor and the PDL Entities will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Minor League Baseball game/event/exhibition. Minor League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to winner’s (and guest’s) consent to and compliance with all health and safety policies of the MLB Entities, including but not limited to the wearing of masks if and when directed and the requirement to be fully vaccinated against COVID-19 (i.e., having received a final vaccination dose at least 14 days prior to the event).
2. Eleven (11) Daily Prize Winners will each receive a goodie basket of select MiLB licensed dog apparel, a signed baseball, and Nationwide branded items at Sponsors’ sole discretion.
Grand Prize ARV: $405
Daily Prize ARV: $80 each
Total Sweepstakes ARV: $1285
4.2 Expenses and Taxes. Prize winners are responsible for any expenses incurred in connection with the prizes. No substitution or transfer of prizes is permitted, except that Nationwide reserves the right to substitute a prize of equal or greater value if an offered prize is unavailable. All federal, state, and local taxes on prizes are the sole responsibility of the winner. Prize details not set forth herein are the sole discretion of Nationwide.
4.3 Legal Documents. If requested, winners must execute and return a W-9 Request for Taxpayer Identification Number and Certification, Affidavit of Eligibility, Liability Release, and (where legal) Publicity Release within three days of notification. Failure to do so may result in disqualification, forfeiture, or award to an alternate winner.
5. General Rules.
5.1. Applicable Laws. All federal, state, and local laws and regulations apply. The Sweepstakes is void where prohibited by law. The prize winner may receive an IRS 1099 form for the value of their prizes. Entrants agree to be bound by the Official Rules and the judges' decisions, which are final and binding on all matters relating to Sweepstakes.
5.2. No Responsibility. Nationwide, and each of its respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees, and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and any entries or mail which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, postage-due, or any combination of the above.
5.3. Nationwide's Rights. Nationwide can void any entrant's entry who it believes has attempted to tamper with or impair Sweepstakes administration, security, fairness, or proper play. Nationwide reserves the right to modify, suspend or terminate the Sweepstakes if necessary due to circumstances beyond Nationwide's control. If the Sweepstakes is terminated early, Nationwide will select the winners from the Sweepstakes Period by random draw from all eligible entries received at the time of termination.
6. Governing Law and Disputes.
6.1. Governing Law. This Promotion is governed by and subject to the laws of the United States and the state of Ohio without giving effect to the conflict of laws rules thereof.
6.2. Disputes. Except where prohibited, the entrant agrees that any and all disputes that cannot be resolved between the parties, and all claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded, or the determination of winner shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages or any other damages, including attorneys' fees. Entrant further waives all rights to have damages multiplied or increased.
7. Privacy.
By entering into this Sweepstakes, you also agree to Nationwide's use of your personal information as described in the Nationwide Privacy Policy at http://www.petinsurance.com/privacy.aspx. Your information will be shared for marketing purposes by the Nationwide family of companies.
8. Winner List.
